NOTICE is hereby given that the Zoning Hearing Board will meet in Council Chambers, Room #118, City Hall, 435 Hamilton Street, Allentown, PA on Monday, February 13, 2012, at 7:00 p.m. for the purpose of hearing the following appeals.
ALL APPELLANTS MUST APPEAR AT MEETING
THE FOLLOWING APPEAL IS REMANDED TO THE BOARD BY ORDER OF THE COURT OF COMMON PLEAS OF LEHIGH COUNTY DATED DECEMBER 14, 2011 FOR THE PURPOSE OF RECEIVING ADDITIONAL EVIDENCE.
1. A-63781 1101 Fullerton Avenue Appeal of John & Nadia Howard to convert vacant first floor retail space into ONE, 2-BEDROOM DWELLING UNIT (for a total of 2 dwelling units), being a change of use granted by the Zoning Hearing Board under Application No. 57037 on February 24, 2003, & having insuff. lot area (4,400 sq. ft. total req.; 2,500 sq. ft. total existing; 0 additional sq. ft. proposed), and not being a detached structure (attached), containing 3,000 sq. ft. or more of floor area (approx. 2,734 sq. ft. existing), located in a Medium Density Residential (R-M) District.

A-64152 602-618 North 7th Street Appeal of Rite Aid of Pennsylvania, Inc. for variance to DEMOLISH EXISTING BUILDING AND ERECT BUILDING (86.1′ x 130.2′ irreg.), with drive-thru canopy (17′ x 20′), 1 sty. @ west side, for use as retail Rite Aid store & Pharmacy, & erect 2 freestanding signs (98.69 sq. ft. x 20′ high on N. 7th Street with 41.82 sq. ft. to be digital, & 79.81 sq. ft. x 20′ high on Allen St.), interior illum.; 3 freestanding directional signs (4 sq. ft. each), 2 @ east side & 1 @ south side, non-illum., 14 flat wall signs (4 @ 129.08 sq. ft. total on N. 7th St., 4 @ 120.09 sq. ft. total on Allen St. & 6 @ 24.85 sq. ft. @ rear), with building exceeding maximum allowable setback (0.0 ft. req. on N. 7th St.;141.8′ proposed; 0.0′ on Allen St. req., 61.4′ on Allen St. proposed), exceeding maximum allowable number, sq. ft. & height of freestanding signs (1 @ 20 sq. ft. x 10′ high permitted; 1 @ 98.69 sq. ft. x 20′ high on N. 7th St., & 1 @ 79.81 sq. ft. x 20′ high on Allen St. & 3 directional signs @ 4 sq. ft. each proposed), exceeding maximum allowable sq. ft. of flat wall signs (40 sq. ft. per street frontage permitted; 129.08 sq. ft. on N. 7th St. & 120.09 sq. ft. on Allen St., & 24.85 sq. ft. @ rear proposed), no new vehicle parking spaces allowed within the area between the front lot line and the principal building (7th & Allen Streets proposed), driveway required to be located from alley in rear (1 on N. 7th St. & 1 on Allen St. proposed), & not having required clear driveway sight triangle at north side of driveway on N. 7th St., located in a Limited Business/Residential (B-1/R) & Traditional Neighborhood Development Overlay (TNDO) District.
